Article 1 Data controller

The data controller under the Swiss Federal Act on Data Protection is LemFid SA, Route des Jeunes 4, c/o TARALEX SA, 1227 Les Acacias, Geneva. Any request relating to personal data protection may be addressed by email to info@helveticassist.ch or by post to the above address.

Article 2 Data collected

In the course of signing up and performing the service contract, Helvetic Assist collects the following categories of data: identification data (name, first name, date of birth, home address, email, phone, nationality, residence status, family situation), contractual data (plan subscribed, commitment duration, payment history), consent data (with timestamp), communication data (written exchanges).

Helvetic Assist does not collect sensitive data within the meaning of the FADP (health data, religious or political opinions, biometric data), except with the Client's explicit and specific consent for a particular service.

Article 3 Purposes of processing

The personal data collected is processed for: contract management (formation, performance, billing, collection, termination), customer service (requests, complaints), referral intermediation (transmission to third-party partners based on explicit consents), customer communication (confirmations, notifications), legal compliance (retention of accounting and contractual data).

Article 4 Data recipients

Transmission of personal data to third-party partners only occurs on the basis of explicit consents granted by the Client in section 4 of the Subscription Form. Each consent is independent and revocable at any time. The Client's phone number is never transmitted to third parties. Only the email address may be communicated to the relevant partners.

Categories of recipients (A–F): (A) Insurance/pension/legal protection, (B) Banking and credit services, (C) Telecommunications, (D) Energy/household services, (E) Authorities and public entities within the scope of mandates, (F) Associations and non-profit groups.

For the operation of its internal tools, Helvetic Assist relies on the following technical subcontractors: Super User Manager, hosted by Infomaniak Network SA (Geneva, CH) — processed in Switzerland; Google LLC for Gmail messaging (USA, Data Privacy Framework certified); Microsoft Corporation for Outlook/Microsoft 365 (USA, standard contractual clauses).

Article 5 Data transfers outside Switzerland

Client personal data is in principle processed and stored in Switzerland. Transfers to the United States only take place in the context of using the Gmail and Outlook email tools, under appropriate safeguards compliant with the FADP.

Article 6 Retention periods

Contractual and billing data is kept for 10 years after the end of the contract. Consent data is kept for the entire duration of the contract plus 10 years. Customer communication data is kept for 5 years after the last interaction. Data transmitted to partners is deleted upon revocation of consent. Accounting data is kept for 10 years in accordance with the CO.

Article 7 Rights of data subjects

Every Client has, in accordance with the FADP, the following rights exercisable at any time by email to info@helveticassist.ch: right of access, rectification, erasure (subject to legal retention obligations), objection, withdrawal of consent. Helvetic Assist undertakes to respond within 30 days. In case of unsatisfactory response, the Client may refer the matter to the Federal Data Protection and Information Commissioner (Feldeggweg 1, 3003 Bern).

Article 8 Data security

Helvetic Assist implements appropriate technical and organisational measures to protect personal data from unauthorised access, loss, destruction or disclosure. In the event of a data breach likely to generate a high risk to the rights and freedoms of data subjects, Helvetic Assist will inform the Federal Data Protection Commissioner without delay.

Article 9 Cookies and website

The helveticassist.ch website may use technical cookies necessary for its operation. No third-party advertising tracking cookie is deployed on the site. Any future deployment of non-essential cookies will be subject to an update of this policy and prior consent collection from users.

Article 10 Changes to the policy

Helvetic Assist reserves the right to modify this Privacy Policy at any time. Any substantial modification will be notified to Clients by email at least 30 days before its entry into force. The current version is always accessible on helveticassist.ch.
